Inkly – Terms of Service

Welcome to Inkly, a product of Progressivity LLC (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of Inkly—including its mobile applications, software, documentation, and any related services or updates (collectively, the “Service” or “Services”).

By registering for, accessing, or using Inkly, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you use Inkly on behalf of an organization, company, or other entity (“Organization”), you represent that you are authorized to bind that Organization, and “you” will refer to the Organization as well.

1. Services Offered

Inkly provides tools that allow you to:

  1. Capture & Edit Paw Prints – Use built-in AI to segment and refine pet paw-print images.

  2. Export Images – Download water-mark-free PNG files using a credit or subscription system.

  3. Credit & Subscription Management – Purchase consumable credits or an optional monthly subscription for unlimited exports.

  4. Cloud Backup (Optional) – At your choice, store processed images in your personal, authenticated Inkly cloud space powered by Firebase.

We may add, modify, or remove features at any time.

2. User Responsibilities

  • Account Security – You are responsible for maintaining the confidentiality of your login credentials (email, password, Google Sign-In, etc.) and for all activities that occur under your account.

  • Accurate Information – You must provide accurate information when creating an account and keep it up to date.

  • Lawful Use – You agree to use the Services only for lawful purposes and in compliance with all applicable laws and these Terms.

  • Content Ownership – You retain all rights to images you capture or upload. You are solely responsible for ensuring you have the necessary rights to use any content processed by Inkly.

3. Subscription & Credits

3.1 Credit Packs

  • Credits are consumable; one export deducts one credit.

  • Credit packs are sold via Apple In-App Purchases and are non-transferable and non-refundable except as required by law or Apple policy.

3.2 Subscriptions

  • An optional monthly subscription unlocks unlimited exports.

  • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.

  • Manage or cancel subscriptions in your Apple ID settings.

3.3 Payment Processing

  • All payments are processed through Apple and/or our payment partner RevenueCat. We do not store full payment details.

4. Prohibited Activities

You may not:

  1. Use Inkly for any illegal, harmful, or abusive activities.

  2. Reverse engineer, decompile, or attempt to extract source code from the Services.

  3. Upload content that infringes on the intellectual-property rights of others.

  4. Attempt to gain unauthorized access to any part of the Service or its related systems.

  5. Introduce viruses, malware, or other harmful code.

5. Termination

We may suspend or terminate your access to Inkly at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may delete your account at any time within the app settings or by contacting support.

6. Intellectual Property

Inkly, including all trademarks, logos, and software, is owned by Progressivity LLC or its licensors. These Terms grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes in accordance with these Terms.

7. Disclaimers & Limitation of Liability

Inkly is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Progressivity LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

8. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app or our website. Continued use after such changes constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arizona, USA, without regard to its conflict-of-law provisions.
